Vernon city council advances land use dispute to court

The owner of Stay and Play the Cypress, Elizabeth Schmitz, addresses the Vernon City Council regarding the ongoing dispute.

The Vernon City Council has decided to allow the court to decide on an ongoing dispute regarding the land use of Stay and Play the Cypress. The issue was discussed at length when Vernon City Council met Monday July 1.
City Attorney Michelle Jordan previously issued a cease-and-desist order against Stay and Play the Cypress on behalf of the city citing that they are utilizing residential property for commercial use. In response, property owner Elizabeth Schmitz communicated her objections via email and then presented her case before council members in the meeting.
Schmitz argued her property is zoned for passive outdoor recreational use, which she asserts encompasses her activities as an Airbnb host.

“We adhere to all organized codes and do not violate any rules that would necessitate a business license,” Schmitz stated.
Conversely, the City maintains that the property is not zoned for business activities and the owners have not sought a zoning change through the planning department.

“At the end of the day, you’re exploiting the creek, “said council member Brittan Brock.
